Welcome to Opulent Bids Auctions. These Terms & Conditions ("Terms") govern your access to and use of our website, services, and platforms (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Opulent Bids LLC.

1. User Accounts and Registration

To participate in auctions or access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account. Opulent Bids LLC cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations. You agree to notify Opulent Bids LLC immediately of any unauthorized use of your account.

You must be at least 18 years old to register for an account and use our Services. By registering, you affirm that you meet this age requirement. Opulent Bids LLC reserves the right to suspend or terminate your account and refuse any and all current or future use of the Services if you provide information that is untrue, inaccurate, not current, or incomplete, or if Opulent Bids LLC has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete.

2. Bidding Rules and Procedures

All bids placed on Opulent Bids Auctions are legally binding. When you place a bid, you are committing to purchase the item at that price if you are the winning bidder.

  1. Bid Increments: Bids must adhere to the specified bid increments for each auction. Bids placed below the minimum increment will not be accepted.
  2. Proxy Bidding: Our platform uses a proxy bidding system. You can enter your maximum bid, and the system will automatically bid on your behalf up to that amount, only raising your bid when necessary to maintain your lead or meet the reserve price.
  3. Reserve Price: Some items may have a confidential reserve price. If the reserve price is not met, the item will not be sold, even if there are bids.
  4. Auction End: Auctions typically have a defined end time. Bids placed precisely at the end time or after may not be accepted due to system latency. We recommend placing bids well in advance of the closing time.
  5. Winning Bidder: The highest bidder at the close of the auction, provided the reserve price is met, will be declared the winner. Winning bidders will be notified via email.
  6. Bid Retraction: Bids generally cannot be retracted once placed. In exceptional circumstances, such as a clear typographical error in the bid amount, you must contact customer support immediately to request a review. Such requests are granted at the sole discretion of Opulent Bids LLC.

3. Payment Terms and Conditions

Payment for winning bids must be made promptly. Failure to pay within the specified timeframe may result in the forfeiture of the item and potential suspension of your account.

  • Payment Due: Full payment for all successful bids is due within 72 hours of the auction's close.
  • Accepted Payment Methods: We accept major credit cards (Visa, MasterCard, American Express), bank transfers, and other secure payment methods as indicated on our platform. All transactions are processed securely.
  • Currency: All prices and payments are in United Arab Emirates Dirham (AED) unless otherwise stated.
  • Taxes and Fees: The winning bid amount does not include applicable taxes, shipping, handling fees, or import duties, which are the responsibility of the buyer. These will be added to your invoice.
  • Non-Payment: In case of non-payment, Opulent Bids LLC reserves the right to relist the item, pursue collection efforts, or take other legal action. A non-paying bidder may also be banned from future auctions.

4. Shipping and Delivery Terms

Once payment is confirmed, we will arrange for the shipping of your purchased item.

  1. Shipping Costs: Shipping costs are the responsibility of the buyer and will be calculated based on the item's size, weight, destination, and chosen shipping method. These costs will be included in your final invoice.
  2. Insurance: We highly recommend insuring your shipment. Opulent Bids LLC is not responsible for loss or damage to items during transit if insurance is declined by the buyer.
  3. International Shipping: We offer international shipping to many countries. Buyers are responsible for all customs duties, taxes, and import fees associated with international shipments. Please check your country's import regulations before bidding.
  4. Delivery Timeframes: Estimated delivery times will be provided upon shipping confirmation. These are estimates only and may vary due to customs processing, carrier delays, or other unforeseen circumstances.
  5. Inspection upon Receipt: Upon receipt of your item, please inspect it immediately for any damage. Any damage must be reported to Opulent Bids LLC within 24 hours of delivery, accompanied by photographic evidence.

5. Authenticity Guarantees and Disclaimers

Opulent Bids LLC strives to ensure the authenticity and accurate description of all items listed on our platform. However, all items are sold "as is."

  • Authenticity: We work with reputable consignors and experts to verify the authenticity of high-value items. Any authenticity guarantees will be explicitly stated in the item's description.
  • Item Descriptions: While we endeavor to provide accurate descriptions, photographs, and condition reports, these are for guidance only. Buyers are encouraged to conduct their own due diligence and request further information or condition reports before bidding.
  • "As Is" Sale: All items are sold "as is," with all faults and imperfections. Opulent Bids LLC makes no warranties or representations of any kind, express or implied, regarding the condition, merchantability, fitness for a particular purpose, or otherwise of the property.
  • No Returns: Due to the nature of auctions, all sales are final. We do not accept returns or offer refunds unless an item is proven to be a deliberate misrepresentation of authenticity by Opulent Bids LLC.

6. Intellectual Property Rights

All content on the Opulent Bids Auctions website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Opulent Bids LLC or its content suppliers and protected by international copyright and intellectual property laws.

  • License to Use: You are granted a limited, non-exclusive, non-transferable license to access and make personal use of our Services. This license does not include any resale or commercial use of our Services or content, any collection and use of any product listings, descriptions, or prices, or any derivative use of our Services or content.
  • Prohibited Activities: You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit for any commercial purpose any portion of our Services without express written consent of Opulent Bids LLC.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Opulent Bids LLC, its affiliates, directors, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of law provisions.

  • Informal Resolution: In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, the parties shall first attempt to resolve the dispute informally through good faith negotiations.
  • Arbitration: If the dispute cannot be resolved informally within sixty (60) days, it shall be submitted to binding arbitration in Dubai, United Arab Emirates, in accordance with the rules of the Dubai International Arbitration Centre (DIAC). The decision of the arbitrator(s) shall be final and binding on both parties.

9. Changes to Terms

Opulent Bids LLC reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
